On Monday i.e 31st May2021 Actress Juhi Chawla filed a civil suit in Delhi high court against the implementation of 5G network in the country. Recently Indian film actress Juhi Chawla, she is also aenvironmental activist came into view as she has filed a suit against the 5G rollout
The actor – environmentalist filed a suit on 31st May in that suit she stated about the radiation and how they are extremely harmful and injurious to the health of people and also harmful for animals as well as flora and fauna. In that statement she said that she is not against implementation of technology advancement but its launch should be prohibited until its certified safe.
After that she has been trolled out on social media for the very same. Replying to all the Memes she posted a video naming ‘hum tum aur 5G ‘and in that she said in a sarcastic tone that she is actually very impressed by the way people connect things and is also impressed by the creativity, and when asked by people why is she doing so she said that she has been raising concerns over years about the increasing radiation and they are in fact very harmful. Wave is increasing as new generations are coming, from 2g to 3g then 3g to 4g now 5g, this all can be very harmful. And in that Instagram video she also talked about sharing the link of the hearing which later became a matter of concern for her. Itwas very wrong on her part to do so, as court proceedings are private matter in the eyes of law and they aren’t to me made public until proper directions of court. Later she also thanked all for the support they gave her.
Justice C Hari Shankar before whom the matter came up transferred the lawsuit to another bench for hearing on 2ndJune 2021.
A bench of Justice J R Midha was they’re for the hearing of this matter. The bench called the suit as a media publicitystunt.
Juhi Chawla and other two plaintiffs including Veeresh Malik and Teena Vachani have been imposed a fine of Rs 20 lakh for abusing the due process of law. A fan entered the meeting and started singing Juhi’s movie song and after given repeated warning by Midha he didn’t stop, after he was being removed from the meeting, he joined serval times and singed various songs from Juhi’s movie. Taking note of the disturbance the court directed that a contempt notice has been issued against the miscreants.
The Court noted that Chawla not only didn't fits the mandate under Section 80 of the Code of Civil Procedure but also flouted several other mandates under the Code.
"The plaintiffs filed this suit on 28th May 2021 within which the Registry objected to the maintainability of the suit. The plaintiffs, rather than explaining how the suit is maintainable, requested the Registry to list the suit because it is with defects and also the plaintiffs undertook up-to-date the value and consequences of the identical, whereupon the Registry listed this matter, subject to objections, before this Court.", the Court observed.
Importantly, the Court said that the plaint wasn't verified. It noted that only some paragraphs were said to be "true to their knowledge".
"There isn't any personal knowledge of averments. Plaint supported legal advice isn't maintainable," the judgment said.
The Court further ordered that the deficient Court-fees of Rs 1,95,594 shall even be paid by the plaintiffs.
Rejecting the request, Justice Midha remarked,
"Matter is over. you have got your legal remedies “
The court said that instead of directly filing a suit in High court she must have gone to the central government and if the central government denies their right, they must have come to the court. The Delhi high court after hearing the arguments of various parties the matter has been kept in abeyance for that while. The court dismissed her plea and called it as a Publicity Stunt.

5G will not only be capable of fast internet speed on our cells and Pc’s but also it will help power internet of things or loTnetworks to run connected cars and homes smarter. 5G will take us to new level of heights there is no doubt in this case but if its affecting all then this matter must be looked into seriously. According to WHO no adverse health has been casually linked with exposure to wireless technologies. Health related conclusions are drawn from studied performed across the entire radio spectrum but, so far, only a few studies have been carried out at the frequencies to be used by 5G. So,studies need to be done in this regard and then implementing it. If it is completely certified safe there is no problem in implementing it.
