INTRODUCTION
In this post, we'll look at how the country's higher court has recently praised Prime Minister Modi. The judiciary and the central government are both different and higher authorities in the Country, and the judiciary always maintains a neutral position on their points in any case, yet in some situations, the judiciary has lauded Prime Minister Modi. A petition was filed to have Prime Minister Narendra Modi's picture removed from vaccination certificates provided through the Cowin platform. "When the country is experiencing a pandemic scenario, the Hon'ble Prime Minister of India issued a message in the vaccination certificate with his images to encourage the morale of the citizens," the single-judge observed in this decision.
Before Allahabad High Court, Judge Shekhar Yadav congratulated Prime Minister Modi on his efforts in the Sanjay Yadav vs State of Uttar Pradesh, where justice Shekhar Yadav praised PM Modi for his efforts in promoting. "Free vaccination" in a country with such a large population as India
In 2018, Justice MR Shah lauded PM Modi, described him as a role model and a hero. “I am delighted, proud, and privileged to participate in this important stage of the issuance of the commemorative stamp of Gujarat high court, and that too by our most popular, loved, vibrant, and visionary leader, honorable Prime Minister Narenda bhai Modi," Justice Shah said at the diamond jubilee celebrations of the Gujarat high court on Saturday, which were also attended by Modi.
In February of 2020, PM Modi, according to Justice Arun Mishra, is "a multifaceted intellect who thinks globally and acts locally”. Justice Mishra was addressing at the first occasion of the International Judicial Conference, 2020, which was attended by sitting judges from over 20 countries, in addition to Prime Minister Narendra Modi and Union Law Minister Ravi Shankar Prasad. Some judges appear to have opted to take their words outside the courtrooms as well, after attempting to rule through obiter. Within the framework of the court, the so-called church-state distinction is blurred, endangering its credibility and the strength of democracy.
Justice MR Shah referred to PM Modi as a "popular, liked, lively, visionary" leader once more in February 2021. They were criticized by the opposing party (Congress), as well as some renowned lawyers, for all of their statements. "Each judge's actions must be consistent with institutional ethics. A judge shall not engage in any action that would smear the judiciary's reputation as a check-and-balances institution.
PM Modi is not the first Prime Minister of our country to be hailed by Supreme Court judges; there has been a Prime Minister of our country before PM Modi. Justice P.N. Bhagwati commended Indira Gandhi. After the Indira Gandhi government's stunning victory in the 1980 Lok Sabha election, Justice Bhagwati, who replaced three senior justices as the CJI, addressed a letter of congratulations to Indira. “I can express my sincere congratulations on your resounding electoral victory and the success of your return as Prime Minister of India. Minister; it is an outstanding feat in which you, your friends, and well-wishers can rightfully take pride.
He told Indira Gandhi, "It is a great privilege to be Prime Minister of a country like India Gandhi.
He didn't stop there, though.
"You have become a symbol of the destitute, starving millions of Indians who have had nothing to hope for and nothing to live for up until now... "I am confident that you will be able to steer the ship of the nation with your iron will and unwavering determination, mysterious intuition and dynamic vision, great administrative capacity and vast experience, overwhelming love and affection from the people, and above all, a heart that identifies with the misery of the poor and weak,” Bhagwati wrote to Indira Gandhi.
Justice Bhagwati was previously a member of the Supreme Court's highly divisive majority opinion in the ADM Jabalpur case, also known as the Habeas Corpus case, in which the court agreed with the government's assertion that the government could take away a citizen's fundamental rights in an emergency. Justice Bhagwati apologized thirty years later, saying that if he could turn the clock back, he would support Justice H.R. Khanna's dissent, which cost Justice Khanna his legitimate opportunity at the Supreme Court chief justice.
CONCLUSION
Both the judiciary and the executive are autonomous and operate within a constitutional framework. Beyond that, no personal or professional relationship should be built on the sole foundations of a healthy democracy. The activity of each judge must be in accordance with institutional ethics. A judge should not take any action that could jeopardize the judiciary's reputation as a check-and-balances system.
