The matter was presented before Justice DY Chandrachud who before ordered DGP and home secretary to make sure there is no conflicts in upcoming election. The court will hear the case on 23 November 2021. TMC also filed petition beforehand for protection against violence in upcoming election for their workers. In the suit it was mentioned that in the beginning of the campaigning for polls the workers of the TMC were threatened by gundaas to prevent party from holding the election. In the following violence 30 cars were damaged and party house have been wricked. On 11 November top court passed order directing the state authorities to maintain the law and order in upcoming election and no parties will be deprived from participating in election. TMC stated that condition are getting worse day by day and court intervention was now required.
