The Supreme Court of India has set aside a High Court ruling condoning a massive delay of 1011 days in filing a subsequent appeal in a matter where no acceptable or suitable justification has been offered while remarking that the High Court has not utilized its authority judiciously. In a civil appeal, Justice MR Shah and Justice BV Nagarathna issued the instruction in a civil appeal against a decision of the High Court of Andhra Pradesh forgiving the present defendants' 1011-day delay in filing the Second Appeal.
