The Supreme Court on Saturday observed that in a claim for motor accident, the amount of compensation to be awarded under the heads of pain, suffering, loss of amenities and happiness cannot be calculated based on a straitjacket formula in [Sri Benson George v. Reliance General Insurance Company Limited and Another].it shall depend upon the facts and circumstances of each case and shall vary from person to person who has suffered, the Court said.The position of claimant is essential factor to be determined after the accident .
