Within a week following the Chhattisgarh High Court's decision awarding Interim Relief to Pharmacy Colleges, the Pharmacy Council of India filed a Special Leave Petition with the Supreme Court. The Chhattisgarh High Court last week granted temporary relief to a group of institutions that had petitioned it to challenge the Government of India's (GOI) and Pharmacy Council of India's (PCI) 5-year moratorium/ban on the creation of new pharmacy colleges in the nation for the next 5 years.
The Chhattisgarh High Court's Single Bench issued interim decisions in Writ Petitions challenging the PCI and GOI's five-year prohibition on the establishment of new pharmacy institutions in the nation.
The High Court found that the Petitioners' claims were prima facie true and that the Interim Relief requested did not substantially affect the PCI's position because they are not obligated to provide final approval letters until the Court makes a final judgement.
