The Delhi High Court granted bail to a guy who had been in detention for 9 years in an NDPS case, stating that while drug trafficking must be prevented with heavy sanctions, the situation of the undertrials cannot be overlooked.
The court was hearing a bail application in a case filed by the Directorate of Revenue Intelligence for offences punishable under sections 9A, 21, 23, and 25A of the Narcotics Drugs and Psychotropic Substances Act of 1985. The Petitioner was detained on July 20, 2012, and his bail application was denied in August 2013, leading to the filing of charges in 2014. Three further bail pleas were then dismissed by the Trial Court. The Court further noted that the Petitioner had been arrested in 2012 and had spent the previous nine years in detention. As a result, the petitioner was granted bail.
