The High Court of Bombay has notified the SOP's e-filing provisions, which are currently limited to cases filed by the government, MACT Appeals filed by insurance companies, Arbitration Petitions, Commercial Cause Suits, Direct Tax Writ Petitions, and cases filed under the Special Court (Trial of Offences Relating to Securities Transactions) Act, 1992.
The SOP will take effect on January 1, 2022.
The following are some of the SOP's important points:
1. Before filing any case, an Advocate or Party-in-Person ("Registrant") must be registered on the High Court of Bombay's portal. Advocates can register on the official website of the High Court of Bombay by clicking here. No one can e-file any case, reply, or document without first registering.
2. Registration on the e-filing site is not feasible unless the Registrant's mobile number and email address are available in the Case Information System (CIS). The e-Filing link on the High Court of Bombay's official website will take the user to the e-filing portal.
3. Prospective Registrant(s) can access the e-filing portal by going to the official website of the High Court of Bombay and clicking on the e-filing link.
4. No Party-in-Person can e-file any case, reply, or document without first registering. During the registration procedure, a party can demonstrate his identity in one of two ways: (a) by uploading documents that prove his identity, or (b) by using a paperless approach with electronic identification.
5. A Registrant's email ID and mobile number will be used as his or her registered email address for sending and receiving documents, notifications, and alerts. Similarly, for sending SMS notification, a registered cell phone number must be utilised.
6. Except for the authenticating page, all text and scanned documents should be combined into a single OCR searchable PDF file and bookmarked according to the Registry's Master Index.
7. The filing number or lodging number will be notified to the Advocate or litigant in person via SMS and/or email after the e-filing is accepted.
