The Bombay High Court held that registration of Copyright is not a mandatory condition for seeking injunction against infringement under the Copyright Act, 1957.
The Single Bench of Justice GS Patel observed that "Copyright Act gives a range of rights and privileges to the first owner of copyright without requiring prior registration,"
The emphasis was put by the Judge on the Section 51 of the Copyright Act which states that the infringement of Copyright is not restricted to the works that are registered with the Registrar of Copyright.
The Court also made a comparison of Copyright with the Trademark stating that the Trademark requires registration to sustain a suit while no such condition is mandatory for filing suit in case of infringement under Copyright.
