The Karnataka high court laid down guidelines to be followed by Child Welfare Committees when parents or guardians surrender their children under section 35 of Juvenile Justice Act
The couple in their twenty were in live in relationship and had left the child at the house of their friends, who intimated the incident to the police.
The couple denied to take care of baby, even after the attempt to convince was made during virtual hearing by additional government Advocate Vijaykumar A Patil and Amicus Curia Advocate B V Vidyulatha.
The court issued these guidelines while hearing a PIL petition filed by NGO Letzkit Foundation, which putforward the unfortunate incident of abandonment of 2 week old child by the parents.
Division bench of CJ Abhay Shreeniwas Oka and Justice N S Sanjay Gowda opined that CWCs have to conduct proper check and identification.
Under section 35 enables a guardians or parents to surrender a child before the CWC on any grounds, be it social, emotional or physical factors beyond their control.
It also mandates that CWC has to conduct a process of injury and counseling and supposed to surrender the child by parents or guardians before the CWC, if it get satisfied.
