A single bench of justice P.V. asha heard the writ petition and told that the continuation of pregnancy would be contrary to safety and interest of the victim who is of 15years.
The minor victim had approached the court with her parents and the FIR has been lodged in Thrikodithanam Police station.As per the medical reports,the gestational period was found to be 22weeks and 6 days
as of December9,2020
Victim girl is not ready and capable to accept the pregnancy and she has also been subjected to sexual assault.
The court stated that as per section5 of the medical termination of pregnancy act,it is allowed to terminate pregnancy beyond gestation period of 20 weeks and to save the life of pregnant woman. The apex court stepped in for the protection of women and had repeatedly held upheld the medical termination where there is a threat to women's life.
The high court noted that the trauma that the minor girl has suffered,she is not prepared to deliver the child and pregnancy can also cause high risk to her health.
Therefore, the court directed the Superintendent of Government to check the medical termination of a minor girl is carried on by competent doctors.
