The Himachal Pradesh High Court while hearing the matter in the case of Sanjeev Kumar v. State of Himachal Pradesh observed that denying a person right to choose spouse on the bases of caste is violative of one’s fundamental rights.
The bench comprising of Justice Vivek Singh Thakur opined that women have the right to choose their spouse and lead their lives as they please. The facts of the case were that the family members of the girl were opposing the marriage and threatening the couple, along with the Petitioner's family because the boy was from a lower-caste background and the girl belonged to an upper-caste (Thakur) family.
