New Delhi: On Tuesday, The Supreme Court had ordered the Real Estate Supertech to demolish its additionally built tower in the Supertech's Emerald Court housing project in Noida Sector 93, causing the violation of the law.
SC directed this order after they caught on that SuperTech has eluded the norms to be maintained between the buildings and fire safety. It further orders that the towers be razed within 3 months at its own cost as well as a refund at a 12 percent annual interest rate to the flat owners within 2 months. Apart from that, SuperTech has been imposed to pay Rs 2 Crore to the Resident’s Welfare Association.
"Within 2 months, all the amount invested by the allotted flat owners is to be refunded by the petitioner (Supertech)," the SC says in its judgment on Tuesday.
As a result, they further gave prosecution orders to the erring officials for its collusion with NOIDA Authority. Along with Sc, Uttar Pradesh Chief Minister Yogi.
Adityanath has called for strict action and an inquiry against guilty officers indulging in the illegal tower construction. As he reviewed the case in Lucknow, he directed the officials to file a criminal case if need be there.
Although Supertech had made its appeal against the Allahabad HC ruling of 2014 in SC. Allahabad HC directed the company to demolish those towers and prosecute the involved officials yet the towers were under construction during HC’s ruling.
