A petition was filed by class 12th students who were either declared fail or were awarded very less marks in improvement examination saying not to cancel there original result in which they were declared as pass
CBSE advocate asked time saying that he recived copy for same on 21 november so justice AM khanwilkar and CT ravikumar posponded the matter till December 6
The court directed advocate mamta appearing on behalf of students to serve an advance copy to counsel of CBSE and central agency .
The petition had requested to the CBSE to maintain original results of the petitioners instead of the result of improvement examination
It was argued in the petition that the students are under an confusion that their original result declared by the CBSE in which they were declared pass will be declared void , on the basis of clause 28 of the Evaluation Policy by CBSE dated June 17, 2021.
Students appealed that they will consider there first result to be the final one . stdents agrued that they appeared for re exam because in guide lines it was clearly stated that these re exams are for improving the marks and students those who appered for these exams are already passes .
It is mentioned in petition that CBSE is bounded by law .
