A bench headed by the CJI heard the appeal of Prabhakar Sindhe leader of BJP in Municipal Corporation of Greater Mumbai seeking the position of Leader of Position (LOP). Earlier, the Bombay High Court rejected the petition of Sindhe, as a result, he filed an appeal in Supreme Court.
The Petitioner's Counsel Mukul Rohatgi told the Supreme Court that earlier when BJP was in the ruling coalition the LOP position was given to the opposition i.e. Congress.
SC asked, " Opposition leader is part of ruling coalition?" and directed the respondents to file the counter.
In 2017, there was the coalition of BJP and Shiv Sena. Shiv Sena emerged as the largest party and BJP as the second largest. BJP denied the post of LOP as it was the part of ruling coalition. Now, the politics has changed and Shiv Sena make a coalition government with Congress.
