Somnath Bharti, an MLA from Malviya Nagar, convicted under sections 147, 149, 323, and 353 of IPC and Section 3 of Prevention of Damage to Public Property Act, 1984 for the offenses of rioting, voluntary causing hurt, assaulting or using criminal force on public servant and mischief causing damage to the public property.
A Delhi High Court, comprising of Additional Chief Metropolitan Magistrate Ravindra Kumar Pandey, was of the view that the prosecution duly proved its case beyond all reasonable doubts and sentenced him to 2-year imprisonment. the other co-accused namely, Daleep Jha, Sandeep, Rakesh Pandey, and Jagat Saini were acquitted by the court as the prosecution was not able to prove its case against them.
According to the complaint, Somnath Bharti With his 300 unknown associates broke the fence of the AIIMS for creating access. He was not accompanied by any government official and also misbehaved and injured the security personnel of AIIMs.
