A law student's petition to appear in one paper of the LLB 5th Semester and thus declare the result of the 6th Semester LL.B Examination was recently dismissed by the Madhya Pradesh High Court.
The undisputed facts are that the petitioner was admitted to a 3-year LL.B course in June 2015, according to the Jabalpur Division Bench of Justice Sheel Nagu and Justice Purushaindra Kumar Kaurav. Clauses 'C' and '13' of Ordinance 111 (Revised) framed under the Vishwavidhalaya Adhiniyam prescribe a maximum period of 5 years within which the three-year LLB course must be completed.
The following relevant clause to this case are:
Clause āCā- A student has a maximum of 5 years to complete his course.
Clause ā13ā- A student must complete his course in no more than five years.
The petitioner was admitted in June 2015, and the 5-year period ended in June 2020, but the petitioner was unable to clear all of the papers, according to the High Court. The University has withheld the outcome and responded that, due to the prohibitions set forth in Clauses 'C' and '13' of the said Ordinance, petitioner is no longer permitted to complete the course.
The petitioner petitioned the High Court for the following reliefs:
(i) To issue an appropriate writ directing the respondents to allow the petitioner to appear in one LLB 5th Semester paper and, as a result, declare the result of the 6th Semester LLB Examination.
(ii) To issue any other writ order or direction that the Hon'ble Court deems appropriate in light of the facts and circumstances of the case, and to request the petitioner's case records.
