A plea was moved by Devangana Kalita, a Pinjra Tod activist, who wanted to find the video footage of violence during anti-CAA protests at Jafrabad on 23rd February, 2020. The ple was disposed by the Delhi High Court.
The Magistrate is open to entertain the application afresh if the accused, Kalita, files the same said the Justice Subramonium Prasad. The court noticed that the application which was rejected by the trial’s court was passed because the investigation qua other accused persons in the matter was not finished.
The accused was arrested on 23rd May, 2020 by the Delhi High Court, but was granted bail. She was re-arrested in an FIR different from the first arrest under Unlawful Activities Prevention Act, related to Delhi riots.
As the Delhi police couldn’t produce evidence to show that Kalita had instigated a particular community she was again granted bail.
The Trial’s court denied the video footage of riots stating that the plea was ”premature” and the court is to take cognizance of the final report.
