The Supreme Court recently issued a notice in a case filed by a mother accusing her 14-year-old daughter of rape and murder after she was discovered hanging in her classroom in Uttar Pradesh. The case was heard by a bench of Justice A.S. Oka and Justice Ajay Rastogi, who requested that the case be transferred from Haryana and Uttar Pradesh police to the CBI or Delhi Police. Two FIRs were filed, the first in Uttar Pradesh for alleged rape and murder of the minor girl and the second in Haryana for abducting two of her siblings and parents. The requested transfer is in relation to these two FIRs. According to the petition, a series of crimes were committed against the deceased minor girl's family members under sections 120B, 365,380, 495, and 506 of the Indian Penal Code, during which they were threatened and abducted from Noida to Haryana via Delhi. In the current petition, the minor's family claims that they were forced to cremate the minor's body without sending it for a post-mortem or even calling the police, that they were also forced to sign blank sheets of paper and that they were wrongfully confined in a classroom. Their cell phones were also taken from them, preventing them from taking pictures or contacting the police, and they were threatened that if they made any noise, the other students in the school would face similar consequences. The petition also states that the family went to the Punjab and Haryana High Court because no action was taken by the UP and Haryana police to transfer the case to the Delhi Police or the CBI, but the High Court denied the requested relief. The petitioner also claims that by leaving the minor's body hanging in the classroom, the principal and other defendants have violated the law. In order to save the minor's life, the parents committed a cruel and degrading act by failing to notify the police or even the doctors. The transfer of investigation has been requested in connection with a series of crimes committed within the territorial jurisdictions of Uttar Pradesh, Haryana, and Delhi.
